有個臨街舖位几年前租給個antique store.租約吧也就一年2年的續。額們也不喜歡長約。因為是在本地易管理，位置極佳。簽長約在這樣的market可能并不合算（現在每年漲百分比的木人會爽額們也不想被框製住，畢竟商產雖糟上升也是遲早的事）

說正題啦。這店是2合股的。約也是共簽，不知咋滴，2人拜拜了。其中一個要求搞份新約就只有他的名字（舊合約早過期了）。額直覺這樣做需要另一個簽字release him.

但貌似這一個不太願意去找另一個（肯定矛盾深決裂那種）。那這樣子額們同這個簽新約會有啥問題嗎？

比如另一個會回來找房東說without his permission can't release him automatically for he was on the original lease.

商業的東東利益牽扯太多，恐怕房東木搞好會惹蟻上身。對伐？

if old lease expired already and no more renew options available to previous leasees, just start a brand new lease.

我有点不同意JY的观点。

如果原来的lease规定到期后，自动转为month-to-month lease，这就不是原来的lease已经terminated，而是原来的lease auto-extended，所以原来的lease没有结束，lessor and lessee的权利义务没有改变。

就是租约没有规定，你现在的做法也是auto extention of lease by mutual agreement。

我建议发一张30-day notice to terminate lease to both 承租人，to terminate existing lease。

然后再签新的租约。

简单，月过月自动延续租约给郭太你可以单方面要求租客三十天解约要考虑重新订合约，否则三十天后现租约将失效.

郭太你所有后顾之忧就没有了。
