private restriction 问题

有一投资房,过户时发生了问题:该房所在的lot 在1939年造了二栋房,小区或二户主间有协议:这个lot只能造二栋面朝西的房子,不能住白人(这个很奇怪,因这是大部分白人的东部很好的小城市)。协议在city court house 备案了。很多年以后房主坼了那二栋旧房,在这 lot上造了三栋房,我们要买是2007年造的朝东。builder有city的permit和 certificate of occupancy。Seller 在2007 年过户时Chicago title 给做了title insurance。另二家owner和seller都不知道有这private restriction。所以seller选了republican title过户, 结果republican title不让我们买title insurance因为这二条violation. 现在chicago title 还是愿意给我们保险. 因为是好 deal 请问大侠们如果买了有何大的risk? 谢谢先了

should be able to remove the restriction, if you can get the other 2 owners agree to, you may want an real estate attorney representing you so may cost you few bucks.
in the past, I had success converting community outlots to divided build-able lots.

it need go in front of zoning board so it will take some time, might as well go ahead close the deal first if its good deal..
